THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION.

Our Duties

We are required by law to maintain the privacy and security of your protected health information (PHI). We must:

  • Provide you with this Notice of our legal duties and privacy practices.

  • Follow the terms of the Notice currently in effect.

  • Notify you if a breach occurs that may have compromised the privacy or security of your information.

What Information We Collect

We create, receive, and maintain health information about you in order to provide care and comply with legal requirements. This may include:

  • Demographic information

  • Health history and intake forms

  • Examination findings and imaging

  • Treatment records and care plans

  • Billing and insurance documentation

  • Records we receive from other providers, insurers, employers, or attorneys

Some of this information may include substance use disorder (SUD) information.

Special Federal Protections for Substance Use Disorder Information

Federal law provides heightened privacy protections for SUD records. In many situations, this information cannot be used or disclosed without your written authorization, except as specifically permitted by law.

Where allowed, disclosures may include limited situations such as:

  • Medical emergencies

  • Public health reporting when required

  • Certain health care operations or payment activities, when permitted by regulation

  • Court orders that meet strict federal requirements

Whenever disclosure is made, redisclosure by the recipient may also be restricted by federal law.

We maintain safeguards to ensure SUD information is handled with the level of confidentiality required by these rules.

How We May Use or Disclose Your Information

We commonly use or share your information in the following ways:

Treatment

We may share information with other health professionals involved in your care.

Example: sending records to your primary care provider or receiving imaging reports.

Payment

We may use information to bill and obtain payment from health plans, auto insurers, workers’ compensation carriers, or you.

Health Care Operations

We may use information to run our practice, improve care, train staff, conduct audits, or for licensing and accreditation purposes.

Other Permitted or Required Disclosures

We may share information without your authorization when required or allowed by law, including for example:

  • Public health and safety activities

  • Health oversight agencies

  • Workers’ compensation claims

  • Law enforcement purposes under defined conditions

  • Coroners, medical examiners, or funeral directors

  • To avert a serious threat to health or safety

Some of these disclosures may be further limited if the information involves SUD records.

Uses and Disclosures Requiring Your Authorization

We will obtain your written permission for uses such as:

  • Marketing communications (where required)

  • Sale of PHI

  • Most disclosures of psychotherapy notes (if applicable)

  • Uses or disclosures of SUD information beyond what federal law allows without authorization

You may revoke your authorization at any time in writing.

Your Rights

You have the right to:

Get a copy of your records – electronic or paper.
Ask for a correction if you believe information is incorrect.
Request confidential communications (for example, contact at a different number).
Ask us to limit what we use or share – we will consider all requests but are not always required to agree.
Get a list of certain disclosures we have made.
Receive a paper copy of this Notice at any time.

Our Responsibilities to You

We will not use or share your information other than as described here unless you tell us we can in writing.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. We will not retaliate against you.

Changes to This Notice

We may change the terms of this Notice, and the changes will apply to all information we maintain. The updated Notice will be available in our office and on our website.
